We have been actively involved in all aspects of the building profession for over 30 years and can provide Expert Witnesses specialising in various areas of construction, surveying and building practice. 

From issues with a domestic extension, to disputes relating to the defective construction of a tower block, Easton Bevins provides Expert Witness services for a huge variety of different projects across various aspects of construction, surveying and building. 

We are instructed on a regular basis by solicitors across the country to produce Expert Witness Reports in compliance with the Civil Procedure Rules which are now mandatory in County Court and High Court cases. Members of our practice have been involved in a number of high profile cases (many reported in the national media), some of which have now set legal precedent.

Types of dispute

Our Expert Witnesses have in-depth knowledge and experience of working on dispute resolution cases.

Construction Disputes

If you have a difference of opinion with your contractor, or if you are a builder and you have a disagreement with a client or subcontractor, you are likely to need to resolve your disputes through arbitration, adjudication, County Court or High Court.

Your solicitor will advise you on the best route to find a solution, but whichever process is chosen, a CPR Part 35 compliant report from an Expert Witness on liability and quantum will be required by the Court or Adjudicating Authority.

Professional Negligence

As experts in the field of Building Surveying, we are fully conversant with the standards that surveyors are expected to meet. Unfortunately, sometimes the advice you receive from your professional advisers falls short of this standard, whether during contract administration, a pre-purchase survey or during the design phase.

We have acted on multiple cases where clients have incurred loss due to negligent advice; these disputes can be settled via various forms of ADR or litigation. Construction Contract Disputes occur either when work is not up to a standard expected, or when a contractor is not paid for work that they have done and thought was of an acceptable standard.

Boundary Disputes

Boundary, neighbour and land disputes have become a more common occurrence in recent times due to the increase in property prices and land values.  If you find yourself in dispute with your neighbours, our Expert Witnesses have in-depth knowledge and experience in this area.

Party Wall Disputes

The Party Wall etc Act 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near neighbouring buildings. Unfortunately, in some cases people do not to follow these procedures.

With in-depth knowledge of the Party Wall etc. Act 1996, we are able to offer Expert Witness services to support our clients. Our expert surveyors will work closely with your legal team to produce CPR Part 35 compliant reports that will be required to further your case.
